1. Provider and scope

These terms apply to the use of the Shopify app “VIP Atelier” by merchants acting in a business capacity.

2. Service

VIP Atelier provides a loyalty program for Shopify stores: points, tiers, rewards as discount codes, referrals, missions, bonus campaigns, storefront widget, Apple Wallet card, analytics and integrations. Features depend on the selected plan.

3. Plans and billing

Billing is handled exclusively by Shopify. Paid plans include a 14-day free trial and are then billed monthly on the Shopify invoice. You can change or cancel your plan in the app at any time; uninstalling ends the subscription.

4. Merchant responsibilities

The merchant defines the rules of its loyalty program and is responsible towards its customers for program terms, privacy notices and honoring rewards, and ensures its use complies with applicable law.

5. Availability

We aim for high availability but cannot guarantee uninterrupted service. Maintenance and updates are carried out with minimal disruption.

6. Liability

We are fully liable for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable damage typical for the contract and to the fees paid in the preceding twelve months.

7. Privacy

Our Privacy Policy applies. For customer data we act as the merchant's processor.

8. Final provisions

German law applies. Place of jurisdiction, where permitted, is Vechta, Germany.
